1. Description of Services

GuardianPro Inspection, LLC dba Guardian Inspections (KY)  provides professional property inspection, water, lead, radon and mold testing, and radon inspection, and mitigation system installation. All services are subject to scheduling availability and site assessments.

2. Text Message Program Terms & Conditions

By opting into our SMS messaging services, you agree to receive text messages related to our services, including appointment reminders, customer support, and important updates.

Opt-In & Consent: You will only receive messages if you have explicitly opted in. We maintain timestamped records of all opt-in actions and comply with the Telephone Consumer Protection Act (TCPA) and all applicable laws.

5. Limitation of Liability

A. "Snapshot in Time" Disclosure: You acknowledge and agree that all property inspections, radon testing, water quality analysis, and lead-based paint assessments provided by GuardianPro Inspection, LLC dba Guardian Inspections (KY) represent a "snapshot in time." Environmental conditions, including radon levels, water contaminants, and lead presence, are dynamic and subject to change due to weather, geological shifts, property usage, or structural modifications. Our reports reflect the condition of the property only at the specific time and date of service.

B. Third-Party Laboratory Reliance: For services requiring laboratory analysis (including but not limited to water and lead testing), we utilize independent, third-party certified laboratories. GuardianPro Inspection, LLC dba Guardian Inspections (KY) is not responsible or liable for any errors, omissions, delays, or inaccuracies in the results provided by these independent facilities.

C. Mitigation and Remediation Results: While our radon mitigation systems and recommendations are designed to meet industry standards, we do not guarantee a permanent or specific level of radon, lead, or water purity post-service. Success is dependent on variables beyond our control, including environmental changes and ongoing property maintenance.

D. Financial Cap on Liability: To the fullest extent permitted by law, the total aggregate liability of GuardianPro Inspection, LLC dba Guardian Inspections (KY), its owners, employees, and subcontractors for any and all claims, losses, costs, or damages—including those arising from negligence, errors, omissions, or breach of contract—is strictly limited to a refund of the actual fee paid by the client for the specific service in question.

E. Exclusion of Consequential and Health Damages: In no event shall GuardianPro Inspection, LLC dba Guardian Inspections (KY) be liable for any indirect, special, incidental, or consequential damages. This includes, but is not limited to:

Loss of property value or "stigma" damages.

Costs of remediation or repairs performed by third parties without our prior written authorization.

Claims related to health effects, illness, or personal injury allegedly resulting from exposure to radon, lead, water contaminants, or other environmental hazards.

F. SMS and Communication Liability: As noted in our Mobile Messaging terms, we are not liable for delayed or undelivered SMS messages. You agree that the failure of an automated reminder or status update does not waive your responsibility for property access or payment obligations.

6. Governing Law

These Terms are governed by the laws of the State of Kentucky.

7. Changes to Terms

We may update these terms periodically. The latest version will always be available on our website.

8. Age Restriction

You must be 18 years or older to participate in our SMS program.
